#video about staking a mineral claim to mine gold and silver on public land (BLM land?) under the “General #Mining Act of 1872” by Brent Underwood, that dude who bought a ghost town. He says you cannot build a cabin on it, put up a fence, or stop people from hiking on it. And he says you haven’t been able to patent claims since the 01990s in the #USA, although the law still seems to support it. He paid US$98.09 to file the claim with the Inyo county recorder. Then he spent several 7 months smelting and cupellating his gold and silver, fluxed with borax and soda ash. His doré bar was 71% lead, 4% iron, 1.67% copper, 0.1% zinc, 16% silver, and no detectable amount of gold. So he got like three or four ounces of silver.
The #USA law that allows #mining of public minerals by staking a claim. “All citizens of the United States of America 18 years or older have the right under the 1872 mining law to locate a lode (hard rock) or placer (gravel) mining claim on federal lands open to mineral entry. (...) Locatable minerals include but are not limited to platinum, gold, silver, copper, lead, zinc, uranium and tungsten. (...) The mining law of 1866 had given discoverers rights to stake mining claims to extract gold, silver, cinnabar (the principal ore of mercury) and copper. When Congress passed the General Mining Act of 1872, the wording was changed to “or other valuable deposits,” giving greater scope to the law. (...) Land dedicated for specific uses such as the White House lawn, national parks, or wilderness areas, is not subject to mineral entry. Land west of the Great Plains managed by the US Forest Service or the Bureau of Land Management, unless designated as wilderness area, is generally open to mining claims. Federal land on or east of the Great Plains was generally acquired by the federal government through purchase, and so is not considered public domain, and is not subject to mining claims. (...) Since 1920, the list of locatable minerals does not include petroleum, coal, phosphate, sodium, and potassium. Rights to explore for and extract these are leased through competitive bidding.” But I think this does not give you ownership of the land! It gives you the right to mine it.

#PDF of the General #Mining Act explains, “The locators of all mining locations heretofore made or which shall hereafter be made, on any mineral vein, lode, or ledge, situated on the public domain, their heirs and assigns, where no adverse claim exists on the tenth day of May, eighteen hundred and seventy-two, so long as they comply with the laws of the United States, and with State, territorial, and local regulations not in conflict with the laws of the United States governing their possessory title, shall have the exclusive right of possession and enjoyment of all the surface included within the lines of their locations, and of all veins, lodes, and ledges throughout their entire depth, the top or apex of which lies inside of such surface-lines extended downward vertically, although such veins, lodes, or ledges may so far depart from a perpendicular in their course downward as to extend outside the vertical side-lines of such surface locations. But their right of possession to such outside parts of such veins or ledges shall be confined to such portions thereof as lie between vertical planes drawn downward as above described, through the end-lines of their locations, so continued in their own direction that such planes will intersect such exterior parts of such veins or ledges.” Does that convey ownership of the land? You have to keep performing labor or improvements to retain it, so I guess not. But you have to pay five dollars per acre.
